DWI stop
In an emergency, call 911 first.
First
Be polite. You have the right to stay quiet.
What to do
- 1Show your license and proof of insurance when asked.
- 2You do not have to say if you have been drinking or where you were. You can say, "I would rather not answer questions."
- 3In Texas, the tests on the side of the road are your choice. This means walking a line, standing on one leg and following a pen with your eyes. You can say no politely.
- 4A small breath test on the side of the road is also your choice.
- 5After an arrest, the officer will ask for a breath or blood test. If you say no, your license can be taken away for months. The police can also get a judge to order a blood test.
- 6Say, "I want to talk to a lawyer." Then stop talking about that night.
- 7You only have 15 days from the arrest to ask for a hearing to keep your license. Call us right away so the 15 days do not run out.
Do not
- Do not argue, fight or run.
- Do not guess how many drinks you had. Do not say "just a couple."
- Do not talk about the night on the jail phone. Those calls are recorded.
- Do not wait. The 15 day clock starts on the day of the arrest.
Reach out to the firm the same day if you can. The 15 days go fast.
